These Terms of Service ("Terms") govern your use of TrackItWeekly, operated by Real Operations, LLC ("Company," "we," "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and have the authority to bind your business to these Terms. By using the Service, you represent that you meet these requirements.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account. Notify us immediately at support@trackitweekly.com if you suspect unauthorized access.

3. Free Trial

We offer a 14-day free trial with no credit card required. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify or discontinue the free trial at any time.

4. Billing & Subscriptions

• Subscriptions are billed monthly or annually in advance
• All fees are non-refundable except as stated in our Refund Policy
• We reserve the right to change pricing with 30 days' notice
• Failure to pay may result in suspension or termination of your account

5. Acceptable Use

You agree not to misuse the Service. See our Acceptable Use Policy for the full list of prohibited activities.

6. Intellectual Property

All content, features, and functionality of the Service are owned by Real Operations, LLC and protected by intellectual property laws. You retain ownership of the data you input into the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9. Indemnification

You agree to indemnify and hold harmless Real Operations, LLC and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any third-party rights.

10. Termination

Either party may terminate at any time. We may suspend or terminate your account for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms are governed by the laws of the state in which Real Operations, LLC is registered, without regard to conflict of law principles.

12. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Changes to Terms

We may update these Terms with notice. Continued use after the effective date constitutes acceptance.
